Usage of myopini
Usage of myopini
a) A User accessing the myopini Platform shall be bound by these Terms and Conditions, and all other rules, regulations, and policies referred to herein or otherwise issued by myopini in relation to any myopini Services.
b) myopini shall be entitled to amend, revise, or update these Terms and Conditions, and any rules, regulations, or terms of use related to the myopini Services, at any time. Any such changes shall be posted on the myopini Platform. Continued usage of the myopini Platform constitutes acceptance of such modified terms by the User.
c) myopini may, at its sole discretion, notify Users of changes to these Terms via email or platform-based notifications. If a User fails to communicate non-acceptance within the time frame mentioned in such communication, the User shall be deemed to have accepted the revised Terms.
d) Certain myopini Services may be governed by additional rules or terms (“Service-Specific Terms”). In case of any conflict between these Terms and such Service-Specific Terms, the latter shall prevail.
e) myopini may, at its sole and absolute discretion:
Restrict, suspend, or terminate access to all or any part of the myopini Platform or Services;
Modify, suspend, or discontinue any features or functionalities;
Reject, move, or remove any User-generated content;
Move or remove any content from the myopini Platform;
Deactivate or delete a User’s account along with related information;
Define general practices and usage limits;
Offer discounts or promotional rewards in forms it deems fit (“Bonus Amount”);
Revise, modify, or remove any data, events, or content offered in connection with an opinion-based interaction;
Assign its rights and obligations under these Terms to any third party, with reasonable notice to Users via registered communication channels.
f) In the event any User breaches these Terms or is suspected by myopini of unlawful, fraudulent, or improper usage of the platform or Services, myopini may, at its sole discretion, and without notice:
Restrict or terminate the User’s access to the myopini Platform;
Deactivate or delete the User’s account and data;
Remove any posted content;
Take any other technical or legal action deemed appropriate.
g) If a platform fee has been charged for use of any myopini Services, and if the User’s access or account is restricted due to an error or negligence on part of myopini, such platform fee shall be refunded without delay. However, no refunds shall be applicable if the restriction or suspension is a result of:
A breach of the Terms by the User;
Circumstances beyond the reasonable control of myopini.
h) By using the platform, Users consent to receive communications including service announcements, administrative messages, and promotional offers from myopini or its partners, licensors, and associates.
i) Any User who is “incompetent to contract” under the Indian Contract Act, 1872 (including minors and un-discharged insolvents) shall not register on or use the myopini Platform. This Agreement, comprising these Terms and Conditions, the Privacy Policy, and any other rules or service-specific policies published on the platform, is an electronic record issued under Rule 3(1) of the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021 and does not require any digital or physical signature.

a) myopini Platform:
Through the myopini Platform, Users can place opinion-based bids on the probability of real-world events occurring. Users make these decisions based on their individual understanding, skill, and publicly available information (including information curated by myopini).

b) Participation on the myopini Platform:
myopini shall publish a wide range of questions relating to the occurrence of future events. These are based on publicly available data and may also allow Users to contribute their own inputs or commentary.
Users may edit or place multiple bids on the outcome of such events depending on the time of the event, volume of interest, and at myopini’s discretion.
myopini will, on a best-effort basis, attempt to match each User’s opinion with a counter opinion from another User. If a match is made, both bids are locked. The result will be determined based on the actual event outcome.
If no matching counter-opinion is found until the lock time of the event, the bid amount shall be returned to the User’s account.
myopini reserves the right to cancel, modify, or reschedule questions or deadlines based on uncertain external scenarios such as legal restrictions, technical errors, or force majeure situations. Reasonable effort will be made to notify Users via SMS, email, or WhatsApp.
Certain event questions may include special bidding rules which will be disclosed prior to bid placement. Such special rules shall supplement these Terms and shall override them in case of conflict.
To place a bid, the User must pay an amount reflecting their stake. The success or failure of the bid will depend entirely on whether the predicted outcome aligns with the real-world result.
All participation via myopini is based on individual analysis. While myopini provides informational content, Users are expected to exercise independent judgment before placing any bid.
Funds for bids are drawn from the User’s digital wallet account maintained with myopini (“myopini Account”).
myopini may define deposit or balance limits (either total or per transaction) at its discretion. All bid amounts, wins, and losses shall reflect in the User’s myopini Account.

Intellectual Property
Intellectual Property
a) The myopini Platform comprises original content curated, compiled, and owned by MYOPINI MEDIA PRIVATE LIMITED, its affiliates, licensors, associates, and contributors. The intellectual property rights (“IP Rights”) in the underlying code, software, databases, visuals, graphics, logos, audio/video elements, charts, and all other platform assets are solely owned or licensed by myopini .
b) Users shall not reproduce, modify, distribute, perform, display, sublicense, create derivative works from, or otherwise use any content or material on the myopini Platform without express written authorization.
c) Users uploading content to the platform (“User Content”) represent and warrant that they own the rights to such content and that it does not infringe any third-party intellectual property rights. Users agree to indemnify and hold myopini harmless against any claims resulting from violation of IP rights due to such content.
d) By uploading content to myopini , Users grant myopini and its partners, licensors, and affiliates an irrevocable, non-exclusive, royalty-free, sub-licensable, worldwide license to use, reproduce, distribute, publicly display, adapt, and transmit such User Content for:
Display on the myopini Platform;
Distribution via media or communication channels;
Storage in databases accessible by Users;
Development of platform features.
All names, trademarks, labels, and intellectual properties of third parties displayed on the myopini Platform remain the exclusive property of their respective owners. Disputes related to such IP rights shall be addressed by contacting the rights owner directly and notifying myopini.

a) The myopini Platform may contain links or references to third-party websites, applications, or services. Use of these external services is governed by their respective terms and conditions, and myopini disclaims all responsibility for such services.
b) All transactions, interactions, or correspondence between the User and third-party vendors (e.g., payment gateways, identity verification tools) are strictly between the User and the third party. Users must review and accept their terms independently.
c) myopini does not guarantee the accuracy, completeness, or reliability of third-party content, tools, or claims. Such materials are provided for User convenience and may not be relied upon as professional or official information.
a) The myopini Platform may contain links or references to third-party websites, applications, or services. Use of these external services is governed by their respective terms and conditions, and myopini disclaims all responsibility for such services.
b) All transactions, interactions, or correspondence between the User and third-party vendors (e.g., payment gateways, identity verification tools) are strictly between the User and the third party. Users must review and accept their terms independently.
c) myopini does not guarantee the accuracy, completeness, or reliability of third-party content, tools, or claims. Such materials are provided for User convenience and may not be relied upon as professional or official information.
User Conduct
User Conduct
a) Users agree to abide by these Terms and Conditions and all applicable platform policies, codes of conduct, and any supplemental terms published on the myopini Platform.
b) In the event a User breaches, or myopini reasonably believes that a User has breached these Terms and Conditions or engaged in any unlawful or improper use of the myopini Platform or the myopini Services, myopini may, at its sole and absolute discretion and without notice:
Restrict, suspend, or terminate such User’s access to all or any part of the myopini Platform;
Deactivate or delete the User’s account and all related data;
Remove any content submitted or uploaded by the User to the platform;
Take any other technical or legal action it deems necessary.
c) Users shall ensure the accuracy, completeness, and correctness of the personal and account information they provide at the time of registration and at all other times. Users agree to update such information promptly to maintain its accuracy.
d) A User shall not register or operate more than one account on the myopini Platform. In case of duplicate accounts, myopini reserves the right to take appropriate action including suspension of all associated accounts.
e) Users provide explicit consent to receive communications from myopini, including administrative messages, promotional offers, transactional alerts, and system notifications via SMS, WhatsApp, email, or push notifications.
f) It is the User’s responsibility to ensure that they can receive all such communications and myopini shall not be liable if messages or notifications remain unread due to filtering or failure to check registered communication channels.
g) Users shall log out of their myopini accounts after each session. myopini shall not be liable for any unauthorized activity or misuse resulting from failure to log out.
h) Users are strictly prohibited from engaging in any of the following activities:
Using cheats, bots, scripts, or automated systems to manipulate outcomes or gain an unfair advantage;
Reverse engineering, decompiling, or tampering with myopini’s code, APIs, or software infrastructure;
Uploading or transmitting viruses, trojans, or malicious files;
Sharing, posting, or transmitting any defamatory, obscene, inflammatory, or illegal content;
Impersonating another individual or falsely misrepresenting affiliations;
Harassing, threatening, or abusing other users or platform personnel;
Advertising or soliciting any third-party services or products on the myopini Platform without written approval;
Engaging in activities that compromise India’s sovereignty, national security, or public order.
i) myopini reserves the right to report violations of this section to appropriate governmental or legal authorities as required under law.
j) Unauthorized access to the myopini Platform or its systems other than via the official interface provided by myopini is a breach of these Terms and applicable Indian law.

b) A valid Indian mobile number is required for registration and account verification on the myopini Platform.
c) Users found to have submitted false, misleading, or inaccurate information—whether regarding their identity, age, or location—shall forfeit all rights to their myopini account and funds. myopini reserves the right to permanently bar such individuals.
d) In case of a minor registering or using the platform under false pretenses, their parent or legal guardian shall indemnify myopini, its directors, and affiliates from all resulting damages or liabilities.

Payment Terms for MyOpini Platform
Payment Terms for MyOpini Platform
a) All transactions conducted on the myopini Platform, including deposits, trades, and withdrawals, are subject to these Payment Terms. Users agree to be bound by the same upon registration.
b) A User can only initiate an opinion or trade if they have a sufficient account balance. If not, the trade will not be processed.
c) Once a trade is initiated, the corresponding amount will be placed on hold and deducted from the User’s available balance until the trade is resolved.
d) myopini may charge a “Platform Fee” for use of its services. This fee (including applicable GST or other taxes) shall be clearly specified and deducted at the time of settlement or trade resolution. An invoice for each transaction shall be generated and made available to the User.
e) The myopini Wallet is structured as a closed-loop payment system comprising the following sub-accounts:
Deposits Account: Balance added via UPI, net banking, cards, or other payment instruments. No refunds shall be provided except in case of non-delivery of services or technical failures attributable to myopini.
Winnings Account: Funds earned from successful trades or opinions. These funds may be withdrawn or used for further trading subject to platform-defined limits.
Trading Account: Where applicable, a percentage of the original stake may be returned in case of specific results. Withdrawals from this account may be adjusted for promotional credits or bonuses availed.
Promotions Account: Non-withdrawable bonus amounts credited at myopini ’s discretion, subject to specific usage conditions.
f) In compliance with applicable regulations, any User account that remains inactive or unused for a continuous period of 365 (three hundred sixty-five) days may be flagged for forfeiture. myopini may, at its sole discretion, reinstate such amounts in part or full upon User request.
g) myopini reserves the right to impose limits on:
Daily and monthly deposits;
Maximum balance caps;
Minimum or maximum withdrawal amounts.
h) Withdrawals shall only be permitted upon successful KYC verification and bank account linkage. The name in KYC documents must match the name provided during registration.
i) myopini reserves the right to reject or delay withdrawal requests that do not meet compliance or verification requirements. Any discrepancy in KYC or bank account details shall result in holdback of funds until the matter is resolved.
j) Promotional amounts and credits are provided at the sole discretion of myopini. Users have no entitlement to such bonuses and their usage shall be governed by the applicable offer terms.
k) All confirmed transactions are final and binding. Refunds, reversals, or modifications shall not be permitted unless mandated by law or system error.

a) If any dispute arises out of or in connection with the myopini Services, including but not limited to issues related to validity, interpretation, performance, or breach of these Terms and Conditions or rights and obligations of the Users and myopini (“Dispute”), the concerned parties shall first attempt to resolve such Dispute amicably through mutual consultation and negotiation within thirty (30) days of a written notice being issued by either party.
b) If the Dispute is not resolved amicably within the stipulated period, it shall be referred to and finally resolved by arbitration in accordance with the Arbitration and Conciliation Act, 1996. The arbitration shall be conducted by a sole arbitrator appointed mutually by the parties. In case of failure to appoint, the arbitrator shall be appointed in accordance with the rules of the Delhi International Arbitration Centre (DIAC).
c) The seat of arbitration shall be New Delhi, India. The language of the arbitration shall be English. The governing law shall be Indian law.
d) Nothing in this section shall prevent either party from approaching competent courts of New Delhi for interim or equitable relief, including but not limited to injunctions or orders to preserve evidence.

a) Users access and use the myopini Platform and Services voluntarily and at their own risk. myopini, including its directors, employees, affiliates, partners, and licensors, shall not be held liable for any direct, indirect, incidental, special, or consequential damages arising from use of or inability to use the myopini Platform.
b) By using the platform, Users agree to release and hold harmless myopini and its officers from any and all liability, loss, or claim arising from:
Access or use of the platform;
Participation in trades or contests;
Misuse of the platform or breach of Terms by the User;
Technical or network failures;
Errors or omissions by myopini or third-party content providers.
